DFS Legal States 2026 — Daily Fantasy Sports State Tracker

As of June 2026, daily fantasy sports (DFS) is legal and available in most US states, but the picture is split. The majority of states either explicitly regulate paid DFS or permit it without specific legislation. A handful prohibit paid contests outright, and a separate group has restricted the “pick'em” / against-the-house DFS format that blurs into sports betting. The table below tracks all 50 states plus DC, with the status and our notes for each.

Traditional peer-to-peer DFS (drafting a roster against other entrants) is treated as a game of skill in most states. The newer pick'em / against-the-house products have drawn regulator pushback because they resemble parlay betting — which is why several states restrict the format even where classic DFS is fine.

Frequently asked questions

Is daily fantasy sports legal?
In most US states, yes. Traditional peer-to-peer DFS is regulated or permitted in the large majority of states. A few prohibit paid contests, and several restrict the pick'em / against-the-house format specifically. Check the 50-state tracker above for your state.
Which states ban DFS?
A small number of states prohibit paid daily fantasy contests; others restrict only the pick'em format while allowing classic draft-style DFS. The table tracks both distinctions per state, because an operator like PrizePicks may offer different products depending on local law.
Why is pick'em DFS restricted in some states where DFS is legal?
Pick'em / against-the-house DFS pits the player against the operator on over/under projections, which several regulators have ruled functions like sports betting rather than a peer skill contest. So a state can permit traditional roster DFS while restricting or banning the pick'em format.

Methodology & disclaimer

This tracker reflects WeeBet's compliance monitoring as of June 2026. It is informational, not legal advice — the legal landscape shifts fast, and an operator may serve or block a region independent of the underlying law. Confirm current status with the operator and your local regulator before depositing or trading. See our responsible gambling resources.
